Who are we?

Bay’s Kitchen produce award-winning, Low FODMAP, Gluten & Dairy Free foods. We have this website to sell our products, allow users to subscribe to our emails, to showcase our Low FODMAP recipes, to provide information on IBS and the Low FODMAP Diet through our information pages and our blog and to provide contact information for us.

How do we collect information from you?

We obtain information about you when you use our website, for example, when you complete the contact form, when you subscribe to our newsletter, when you complete the site registration form, purchase a product(s) from our store or engage with other forms within our site.

What type of information is collected from you?

When you visit the Site, we collect certain information about your device, your interaction with the Site, and information necessary to process your purchases. We may also collect additional information if you contact us for customer support. In this Privacy Policy, we refer to any information that can uniquely identify an individual (including the information below) as “Personal Information”. Order information

  • Examples of Personal Information collected: name, billing address, shipping address, payment information (including credit/debit card numbers)*, email address, and phone number.
  • Purpose of collection: to provide products or services to you to fulfill our contract, to process your payment information, arrange for shipping, and provide you with invoices and/or order confirmations, communicate with you, screen our orders for potential risk or fraud, and when in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
  • Source of collection: collected from you.
  • Disclosure for a business purpose: shared with our processor Shopify, PayPal, Recharge, Unleashed and Mintsoft.

*Please note: If you purchase a product from us, your card information is not held by Bay's Kitchen or passed to our other processors (Unleashed, Mintsoft etc). It is collected by our third-party payment processors, who specialise in the secure online capture and processing of credit/debit card transactions, as explained below.

We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you, as described above. For example:

Using Personal Information

We use your personal Information to provide our services to you, which includes: offering products for sale, processing payments, shipping and fulfillment of your order, and keeping you up to date on new products, services, and offers.

How do we protect your information?

Our website is scanned on a regular basis for security holes and known vulnerabilities in order to make your visit to our site as safe as possible.

Your Personally Identifiable Information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. In addition, all sensitive information (such as credit or debit card details) is encrypted and protected with the following software 128 Bit encryption on SSL. When you are on a secure page, a lock icon will appear in the search bar next to your URL in browsers such as Google Chrome.

We implement a variety of security measures when a user submits, or accesses their information to maintain the safety of your Personally Identifiable Information. However, non-sensitive details (your email address etc.) are transmitted normally over the Internet, and this can never be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee the security of any information you transmit to us, and you do so at your own risk. Once we receive your information, we make our best effort to ensure its security on our systems. Where we have given (or where you have chosen) a password which enables you to access certain parts of our websites, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Who has access to your information?

We do not sell, rent or trade your personal information to third parties, and we will not share your personal information with third-parties for their marketing purposes.

However, some partner companies may have access to your Personally Identifiable Information. These include Mintsoft (for order fulfilment), Unleashed (for order processing), PayPal (for order payment), Recharge (for subscription orders and payment), Facebook, Google, Klaviyo and Awin for advertising, tracking and reporting purposes. Each of these companies have Privacy Policies and therefore agree to keep this information confidential. We may also release information when its release is appropriate to comply with the law, enforce our site policies, or protect ours or others’ rights, property or safety. 

When we use third-party service providers, we disclose only the personal information that is necessary to deliver the service and we have a contract in place that requires them to keep your information secure and not to use it for their own direct marketing purposes. Please be reassured that we will not release your information to third parties beyond the company for them to use for their own direct marketing purposes, unless you have requested us to do so, or we are required to do so by law, for example, by a court order or for the purposes of prevention of fraud or other crime.

If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. Our Marketing
